These Terms & Conditions ("Terms") govern your use of www.mayadb.in and your engagement with MAYA Design & Build ("MAYA", "we", "us"), Shop 5, Seven Leaf Arcade, Dhamdod-Lumbha Road, Bardoli, District Surat, Gujarat, India. By using this website, submitting an enquiry, requesting a quotation or booking a site visit, you agree to these Terms. If you do not agree, please do not use the website.

1. Our Services

MAYA provides architectural design, interior design, engineering, project management and turnkey construction services for residential, commercial and other projects. The exact scope of work for any project is defined only in the written proposal, agreement or work order signed by both parties.

2. Estimates, Calculators and Quotations

• Cost calculators, packages and online quotations on this website are indicative estimates for planning purposes only. They are not a final offer or a binding contract.
• Final pricing depends on a physical site inspection, measurements, soil and structural conditions, approved drawings, chosen materials and specifications, and applicable statutory requirements.
• Unless stated otherwise, online quotations are valid for 15 days from the date they are generated. After that, rates may be revised due to changes in material, labour or other costs.
• Prices shown are exclusive of GST unless clearly mentioned. GST and other applicable taxes are charged at the rates in force on the date of invoice.
• Package inclusions, brands and specifications shown on the website are representative. Equivalent alternatives may be used where a listed item is unavailable, with prior intimation to the client.

3. Consultations and Site Visits

• Site-visit dates and time slots selected online are requests and are confirmed only after our team contacts you.
• We may reschedule a visit due to weather, travel or other unforeseen reasons and will inform you in advance.
• Any fee for consultation or site visits, where applicable, will be communicated to you before the visit.

4. Engagement and Agreement

• A project begins only after a written agreement, proposal or work order is signed and the agreed advance payment is received.
• The signed agreement sets out the scope of work, deliverables, timelines, payment schedule and specifications. If there is any conflict between the website and the signed agreement, the signed agreement prevails.
• Any work outside the agreed scope, or any change requested after approval of drawings or commencement of work, will be treated as additional work and charged separately after your written approval.

5. Payments

• Payments are to be made according to the milestones in the signed agreement, through bank transfer, UPI, cheque or other modes we accept. Receipts and tax invoices will be issued for all payments.
• Work may be paused if a due payment is not received on time, and the project timeline will be extended accordingly.
• Statutory fees, government approval charges, utility connection charges and similar third-party costs are payable by the client unless expressly included in the agreement.

6. Client Responsibilities

• Provide accurate information, valid ownership or authorisation documents for the site, and timely access to the site.
• Obtain or co-operate in obtaining approvals from the relevant authorities, unless this is included in our scope.
• Give timely decisions and approvals on drawings, materials and selections. Delays in approvals may extend the project timeline.
• Provide basic site facilities such as water and electricity during construction, unless agreed otherwise.

7. Timelines and Delays

We make every reasonable effort to complete work within the agreed timeline. We are not responsible for delays caused by circumstances beyond our reasonable control, including natural calamities, extreme weather, pandemics, government orders, strikes, shortage of materials or labour, approval delays, site disputes, or delays in client decisions or payments.

8. Cancellation and Refunds

• If you cancel an engagement after signing the agreement, charges for work already completed, materials procured or ordered, and any expenses incurred up to the date of cancellation will be payable or adjusted against the advance.
• Any balance amount, if refundable under the agreement, will be returned within a reasonable time after settlement of accounts.
• Specific cancellation and refund terms in your signed agreement will apply over this general clause.

9. Intellectual Property

• All designs, drawings, 3D views, specifications and documents prepared by MAYA remain the intellectual property of MAYA Design & Build.
• On full payment of the applicable fees, the client receives the right to use these designs only for the specific project and site for which they were prepared. They may not be reused, copied, sold or used for another project without our written permission.
• Content on this website, including text, photographs, project images, sample drawings, logos and graphics, belongs to MAYA or is used with permission. It may not be copied or reproduced without our prior written consent.
• We may photograph completed projects and use them in our portfolio and on social media. We will not publish your personal details, and you may ask us in writing not to feature your project.

10. Warranties

Workmanship and defect-liability terms, if any, are as specified in the signed agreement. Manufacturer warranties on materials, fittings, fixtures and appliances are passed on to the client as provided by the manufacturer, and claims are subject to the manufacturer's terms.

11. Use of the Website

You agree not to:

• Submit false, misleading or someone else's information.
• Attempt to gain unauthorised access to the website, its admin areas or its systems.
• Copy, scrape or misuse content from the website.
• Use the website for any unlawful purpose.

We may update, change or suspend any part of the website at any time without notice.

12. Third-Party Links

Our website contains links to third-party services such as WhatsApp, Google Maps, Instagram and Facebook. We are not responsible for the content, policies or practices of these services.

13. Limitation of Liability

Information on this website is provided in good faith for general guidance. To the maximum extent permitted by law, MAYA is not liable for any loss arising from reliance on website estimates or general information without a signed agreement. Our total liability for any claim relating to a project is limited to the fees actually paid to us for that project, and we are not liable for indirect or consequential losses.

14. Privacy

Your personal data is handled according to our Privacy Policy, available at www.mayadb.in/privacy.

15. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute will first be attempted to be resolved through mutual discussion. If it cannot be resolved, it shall be subject to the exclusive jurisdiction of the courts at Surat, Gujarat.

16. Changes to These Terms

We may revise these Terms from time to time. The updated version will be published on this page with its "Last updated" date, and it applies from the date of publication.
